The following outlines the terms, policies, and commitments that guide my work. Please take a moment to read them.

Preamble

The purpose of these General Terms and Conditions of Sale (“GTCS”) is to govern the contractual relations between: the Client (hereinafter “the Client”) and Virginie Jones (hereinafter “the Photographer”, registered office: 18 chemin des Amandiers – 11800 Villedubert, contact email: hello@virginiejones.com, contact phone: 06.67.05.96.53, SIRET: 844 720 821 00025)
These GTCS apply to all orders for services and products concluded between the photographer and her client.

Rates

Rates are quoted in EUROS and include tax. They are agreed upon when booking the photo session.

03.

Reservation and Payment

Booking a photographic service is done via the online booking form on the website www.virginiejones.com or by phone at 06.67.05.96.53. The booking request implies full acceptance of these GTCS.
A photo session booking is not final until payment of the session fee in the amount of 150€ is received.
If payment is not received within 8 days from the booking date, the photographer is no longer obliged to reserve the date for the Client.
Accepted payments at booking: bank card, check or cash (hand‑delivered against receipt).

04.

Withdrawal Period

The client has a withdrawal period of 14 working days from the day after the booking. Any withdrawal decision made within the allotted time will result in a refund of the amount actually paid.
After this 14‑day period, the amount paid for the order will no longer be refunded.
“The right of withdrawal cannot be exercised for service contracts fully performed before the end of the withdrawal period and whose performance has begun after the consumer’s prior express agreement and express waiver of their right of withdrawal.” (Consumer Code – Article L221‑28)
The right of withdrawal does not apply to ordered products (Article 121‑20‑2 of the Consumer Code).

05.

Gift Cards

Gift cards are neither exchangeable nor refundable. They are sent within 7 days after receipt of payment.
The beneficiaries of the gift card have a period of 6 months to carry out the service. Beyond that, the gift card becomes permanently unusable for any reason.

06.

Conduct of a photo session

The photo session takes place either outdoors or at the client’s home or at the studio set up by Virginie Jones. The client undertakes to respect the scheduled time for the photo session. Any delay on their part, even justified, will be deducted from the time allocated for the session.
For the session to take place under the best conditions, only the persons participating in the session may attend (unless previously agreed by the photographer).
For “Newborn” and “Baby” sessions, Clients agree to report any health problem that could compromise the photo session. Otherwise, the photographer cannot be held responsible in the event of an incident.

07.

Cancellation and Postponement

In the event of cancellation of the session by the photographer, an alternative date will be offered whenever possible, and if no agreement is found, the session fee will be fully refunded.
In the event of loss or deterioration of the photos before their delivery, the client may only claim a refund of the photo session.

08.

Post‑processing and photographic style

The photographer undertakes to process the photographs according to the rules of the art and to carry out all necessary corrections.
Post‑processing, like the shooting, is unique to the photographer and is an integral part of her work, her style and her artistic world. The photographer is the only one to decide on the post‑processing she will apply to the digital files. Only photographs processed by the photographer will be usable by both parties. No raw shots will be given to the Client, nor can they be required, and the photographer reserves the right to destroy them within a timeframe at her discretion.
Clients acknowledge the photographic style of MademoiselleZoom and request her services with full knowledge of her artistic style.

09.

Choice and Receipt of Products

At the end of the photo session, the Client chooses the products they wish to order from the Collections indicated in Virginie Jones’s price guide. The order will be effective after payment of the full amount of the session and/or products ordered.
In accordance with article 121‑20‑2 of the Consumer Code, the right of withdrawal cannot be exercised for these products, considered to be clearly personalized.
Products will be delivered to the Client at Virginie Jones’s studio within 3 to 4 weeks depending on the product ordered. Digital files will be sent by email and by download.

10.

Conservation of Digital Files

The photographer undertakes to keep the digital files (except in the case of a disaster beyond her control such as a flood, fire or other) for 1 year after the date of shooting. Beyond that, the backup of the files is no longer guaranteed and they may be destroyed.

11.

Payment in 3 installments

Virginie Jones offers payment in three installments.
The first payment corresponds to the session fee, which is mandatory to book the session.
The second and third payments correspond to payments for photographic products. They will be agreed jointly with the Client and Virginie Jones. A copy of the payment plan with the payment dates will be provided to the Client.

12.

Intellectual Property

The use of the photographs taken is subject to the legal provisions of copyright, governed by the law of March 11, 1957. Delivering the photographs entails the transfer of the right to reproduce the photographs on any medium and any format only within the private and family context.
In the event of publication of the photos on the Internet by the client, the client undertakes to mention the author: Virginie Jones.

13.

Image Rights and Authorization to Publish

According to articles 226‑1 to 226‑8 of the Civil Code, every individual enjoys a right to respect for their private life as well as a right to their image. The client is, by law, the inalienable owner of their image, and the photographer strictly respects this image right.
Unless otherwise notified in writing by the client, the photographer reserves the right to use photographs from a photo session for the promotion of her activity.
The agreement includes, among other things, the publication or use of photos for the author’s promotion through:
- Exhibitions and competitions
- Reproduction in catalogs, press kits, posters or postcards
- Any existing or future representation process such as business cards, the photographer’s personal portfolio...
- Websites or web galleries, and in particular www.mademoisellezoom.com or social networks.
